“You both do not have any love for your child and are just fighting on the child’s expense,” the Court added on finding that the child had been sick since last November.
On Monday, the Supreme Court expressed concern for the well-being of a child embroiled in a custody dispute between their parents. A Vacation Bench, consisting of Justices PV Sanjay Kumar and Augustine George Masih, urged the warring parents to prioritize the child’s proper care, particularly during the sweltering summer in Delhi, instead of persisting in their conflict. The Court was distressed to learn that the child has been unwell since last November.
“You have not been able to find a good pediatrician till now. Both parents are making a pawn of their child. Absolutely terrible. You both do not have any love for your child and are just fighting on the child’s expense. So many months have passed,” Justice Kumar remarked, while addressing the parents.
“We are only concerned with rights of child and not any of you both. Take care of your child. It is extreme heat,” Justice Masih weighed in.
The Court underscored the importance of protecting the child’s rights and interests. After hearing both parties, it decided to grant the father visitation rights.
