On Tuesday, the Punjab Haryana High Court utilized artificial intelligence technology called Chat GPT to determine the bail application of an accused individual, which was ultimately rejected. The bench, headed by Anoop Chitkara, requested a response from Chat GPT while hearing the case of an accused person who had been arrested in June 2020 on charges of rioting, criminal intimidation, murder, and criminal conspiracy.
After reviewing the response provided by Chat GPT, Justice Chitkara utilized their own previous experiences and decisions to reject the accused’s bail plea. The judge stated that causing death is inherently cruel, but if cruelty results in death, the circumstances become different. In cases where physical assault is committed brutally, the parameters for granting bail are also altered.
The court clarified that the mention of Chat GPT and any corresponding observations were only intended to provide a wider perspective on bail jurisprudence, specifically in cases where cruelty is a factor. In response to the court’s use of Chat GPT, a lawyer from the high court named Saurav expressed that it was a positive step, which could have both positive and negative effects that would become clear over time. He also emphasized that artificial intelligence could not pose a threat to lawyers’ jobs but could only serve as a useful tool.
Nishadh Ahuja, a lawyer who has been practicing in the Punjab Haryana High Court for the past three years, responded to the judgment involving Chat GPT by stating that in the beginning stages, the use of this technology may not be a threat to lawyers, but could instead be used as a tool to facilitate their work in the future. Chiryanshu, another lawyer with five years of experience in the same court, mentioned that the use of Chat GPT is still in its early stages.
He added that it is premature to say that this technology could threaten lawyers’ jobs since computers were once perceived as a potential threat, but they now play an integral role in the IT sector, generating employment for many people.
