The Delhi High Court directed all district courts in the national capital to allowing the parties/lawyers to appear before them for proceedings of their cases in hybrid or video conferencing mode without any prior request.
Through the circular issued on Monday, the High Court has given directions and guidelines to the district courts in National Capital regarding the conduct of hybrid hearings.
The High Court circular says, ” The hearings shall be conducted in hybrid/video-conferencing mode in conformity with the High Court of Delhi Rules for Video Conferencing for Courts 2021 and also bearing in mind the provisions of the Live Streaming and Recording of Court Proceedings Rules of the High Court of Delhi 2022.”
The circular also states that during conduction of hearings through hybrid or video-conferencing, the judges shall ensure that no person except the parties and lawyer of a particular case can access/join the proceedings especially if the matters are related to matrimonial disputes, child custody, sexual offences, Juvenile Justice Act, POCSO Act, medical termination of pregnancy, etc.
It further states, “Further in a given case, the Court may for reasons to be recorded in writing direct the parties and/or their Counsel to appear physically where in the opinion of the Court of the physical presence of the parties/counsel in the court is required or where the court is otherwise of the opinion that the matter should be heard physically in the court.”
And all the judicial officers of the District Courts have been requested to strictly adhere to the given directions.
