High Court had dismissed the order of the family court causing prejudice to a woman. The family court had rejected her cross examination right. She had prayed to cross examine her husband.

The court observed that matrimonial cases are to be decided quickly but not at the cost of the parties. Right of the parties to do the cross examination should not be curbed based on technical grounds.

The woman had alleged that she was given just one opportunity for the cross examination.Her lawyer had sought time to cross-examine the husband. Also, the lawyer was not provided the evidence copy of the husband.

High Court stated that gross prejudice has been caused to the wife. Hence, the court allowed the wife to cross examine the husband on the next date. It was allowed with a payment of Rs. 25000 as cost for causing trouble to the husband.
