A Kerala court on June 17 sentenced a fake antique dealer Monson Mavunkal to life imprisonment in a case under the POCSO Act in which he was found guilty of sexually abusing a minor girl.

Judge K Soman said that the accused Mavunkal committed repeated rape on the minor girl by taking advantage of the poor financial condition of her family. He also aborted the girl’s pregnancy at his residence.

The Additional District & Session Court was considering a case against Mavunkal under several provisions of the POCSO Act and Sections 370 (4), 342, 354 A (1) (iii), 354 (A), 376 (2) (n), 313, 506 (i) of the Indian Penal Code (IPC).

As per the prosecution case, the accused had raped the girl repeatedly. The girl was just 17 years old and had conceived due to rape. The accused unlawfully aborted the pregnancy of the minor.

The mother and brother of the minor girl were employed under the accused. Since they were living in a dilapidated house in a miserable condition, taking advantage of the condition, the accused gave them greed to construct a house for them and promised to teach the minor girl cosmetology by claiming that he was a cosmetology doctor.

The accused showed obscene pictures to the minor girl on his iPad and touched her body with sexual intent followed by committing rape on her. He raped the minor girl several times and impregnated her. He aborted the pregnancy of the girl by giving a tablet to the girl saying that it is a Vitamin tablet, and also inserted another tablet inside her vagina.

He kept on sexually abusing her till she turned major, the prosecution alleged further.

Mavunkal denied all the allegations put against him and contended that his case was falsely created with the help of his rivals.

Furthermore, he also contended that the minor girl had given a statement to the Crime Branch related to a cheating case registered against him but had not made the allegation of rape against him at that time.

When considered the facts, evidence on record, and circumstances of the case, the Court found Mavunkal guilty of committing repeated rape on the minor girl.

As a result, the Court convicted him and sentenced him to life imprisonment along with a fine of ₹5.25 lakh.
